IRS Cracking Down on Home Care Industry Miss-classification of workers. The ramifications for an employer can vary depending on whether or not the DOL and the IRS determine the misclassification was unintentional or intentional, or even fraudulent. If the misclassification was unintentional, the employer faces at least the following penalties based on the fact that all payments to misclassified independent contractors have been reclassed as wages: $50 for each Form W-2 that the employer failed to file because of classifying workers as an independent contractor. Since the employer failed to withhold income taxes, it faces penalties of 1.5% of the wages, plus 40% of the FICA taxes (social security and Medicare) that were not withheld from the employee and 100% of the matching FICA taxes the employer should have paid. Interest is also accrued on these penalties daily from the date they should have been deposited. A Failure to Pay Taxes penalty equal to 0.5% of the unpaid tax liability for each month up to 25% of the total tax liability. If the IRS suspects fraud or intentional misconduct, it can impose additional fines and penalties. For instance, the employer could be subjected to penalties that include 20% of all of the wages paid, plus 100% of the FICA taxes, both the employee's and employer's share. Criminal penalties of up to $1,000 per misclassified worker and 1 year in prison can be imposed as well. In addition, the person responsible for withholding taxes could also be held personally liable for any uncollected tax.
Informational Only It has been brought to my attention by several of my employees, that there are several companies out there that are recruiting them, wanting to pay them under the table(cash) or 1099 (as independent contractor) If you are searching out care for a loved one, please read. This could save you a lot of heart ache. Independent contractors are not eligible for workers' compensation coverage; employers are not required by state law to purchase coverage for independent contractors. However, some employers misclassify employees as independent contractors to avoid paying payroll taxes and workers' compensation premiums for their employees. However; if a worker is injured on the job an employer may try to deny that the worker was an employee, whether or not a worker is an employee is not controlled by what name the employer uses for the worker, but by the circumstances surrounding the employee's work. Let’s discuss each one in further detail. Independent Contractor: An independent contractor controls how the service is provided, who provides it, and the method of accomplishing it. The key is the independent contractor acts independently, free of direction and control of the hiring company (employer). Independent contractors typically receive payment by the job. That means that if you hire an in-home care company to take care of a loved one, and they have classified there help as contractors, 1. They will not have workers compensation insurance and you as the home owner could be at a very high risk of liability and 2. They are not withholding appropriate State and federal Taxes. Independent contractors almost always work for more than one company. Employees: When the worker is trained by and receives regular work from the same company, and paid by the hour, the worker is more likely to be considered an employee. If workers are Instructed what time to be at their place of work, how to do the work, how long to stay on the job each shift, and what time to depart, such as home care industry, almost always classified as employees. Why Do Employers Misclassify Employees? The simple answer is money. By classifying a worker as an independent contractor instead of employee, an employer avoids the following expenses: Employer's share of Social Security and Medicare taxes Employee benefits, including vacation, holiday, and sick pay Unemployment compensation tax Workers' compensation insurance In the home care industry, Employers Misclassify workers for the aforementioned as well as being able to undercut the rates of those companies that are doing business legally . They will tell you that they do background checks, drug screens and have insurance. Key word insurance. They will purchase blanket general liability insurance. This may help if one of the workers Is fixing a meal and burns the house down, but in this high risk field of injuries, general liability insurance is worthless when it comes to workers hurt on the job. I recommend you never let anyone in your house that is not covered under workers compensation insurance by the company performing the services. Make them produce you a Certificate of Workers Compensation and call and verify. In my next post, I will outline 20 key questions to ask when interviewing home care companies.
