Hi. My name is Jessica Schlueter and I need help spreading the word on a wrongful death of an infant. I recently was 4 and a half months pregnant with a little girl. My daughter Jakki Ocean Schlueter. I have A- blood and with that any child that I have that is not born with the same blood type runs the risk of passing away. I have already had one child die from hydrops. (Please refer here to description of what hydrops is. Thanks. http://www.stanfordchildrens.org/en/topic/default?id=hydrops-fetalis-90-P02374.) We had to go to the Texas Children's Hospital in Houston Texas to be admitted so they could watch my daughters development. Blood transfusions were a necessary part of the healing process for Jakki, which the doctors performed. Some blood transfusions are more deadly than others. (Please refer to http://www.webmd.com/baby/intrauterine-fetal-blood-transfusion-for-rh-disease) There were three transfusions performed. Two through Jakkis umbilical cord and one through my stomach and into her abdomen. We approved of the non-threatening procedures which were the first two that the doctors performed. The third transfusion however was a transfusion through the abdomen which is very dangerous especially to a baby so young in the womb, which we specifically told them to not perform. i went in the operating room for the third transfusion while under the impression they were still giving jakki the non lethal transfusion. however when the procedure was done, the bandage was not in the same spot that the other two had been when I came out of surgery. It was on my lower stomach which meant that they had not done the umbilical cord transfusion that me and my husband had consented to. They had gone through the baby's abdomen. About 16 hours later the doctors had done an ultrasound to check on the baby. Her heart was no longer beating. My baby girl was gone, never to experience life on the outside rather than life just in the womb. Shortly after my daughters death family advocacy contacted us and asked us if we would like for them to investigate her death. We had told them no. But due to the extenuating circumstances they went ahead and did an investigation anyways. Then about a month later we got letters in the Mail from the hospital itself stating that family advocacy had went ahead and did an investigation on Jakkis death and came to the conclusion that it was a wrongful death of an infant due to doctor negligence. Now, since then we have contacted about 6 lawyers and have tried to file a lawsuit on the hospital or doctors or whoever would be considered responsible to sue. We have had no luck in doing so. Each lawyers office has told us that they are not able to take the case. It is risky due to the type of lawsuit it is. Then one of the offices we talked to told us that in the state of Texas unless the "fetus" (their word, not mine) has taken a breath outside of the womb, it is not considered a person. This is where your help comes in. If there's any way you can help get the attention of others in a way that helps us or someone else so this doesn't happen to others I would really appreciate it. This is not right that they are letting doctors (especially from a Children's Hospital) pretty much get away with murder with no consequence.
