📌 New vs Established Patients

📌 Some keywords are “exact same speciality”, “subspeciality”, “3 years”, and “same group” Are your subspeciality credentialed as a subspecialty? These are all good questions to ask. Do you payers honor of except subspecialties?

📌 Per AMA, Solely for the purposes of distinguishing between new and established patients, professional services are those face-to-face services rendered by physicians and other qualified health care professionals who may report evaluation and management services. A new patient is one who has not received any professional services from the physician or other qualified health care professional or another physician or other qualified health care professional of the exact same specialty and subspecialty who belongs to the same group practice, within the past three years.

📌 An established patient is one who has received professional services from the physician or other qualified health care professional or another physician or other qualified health care professional of the exact same specialty and subspecialty who belongs to the same group practice, within the past three years. See Decision Tree for New vs Established Patients.

📌 In the instance where a physician or other qualified health care professional is on call for or covering for another physician or other qualified health care professional, the patient’s encounter will be classified as it would have been by the physician or other qualified health care professional who is not available. When advanced practice nurses and physician assistants are working with physicians, they are considered as working in the exact same specialty and subspecialty as the physician.

🎯 CMS Claims Processing Manual update

🎯 SUBJECT: Billing and Payment for Telehealth Services with Place of Service (POS) 10

Special Considerations for Telehealth Claims (Codes 02, 10)

Beginning in CY 2024, practitioners may receive either the facility or the non-facility payment rate for an otherwise eligible Medicare telehealth service, depending on whether the billing practitioner selects POS code 02 or POS code 10.

The only two valid POS codes for Medicare telehealth billing in CY 2024 are POS 02 and POS 10. As appropriate, POS 02 or POS 10 may be used and must be paired with the appropriate telehealth modifier (modifier 93 for audio-only and modifier 95 for audio/video).

The payment rate for POS 02 is the facility payment rate (F); the payment rate for POS 10 is the non-facility rate (NF). Use of audio-only (93) or audio-video (95) does not change rate of payment, only the POS code determines the non-facility or facility payment rate.

RPM in Chronic Disease Management

Chronic diseases such as diabetes, hypertension, heart disease, and chronic obstructive pulmonary disease (COPD) require ongoing monitoring and management. RPM plays a critical role in managing these conditions by providing real-time data that healthcare providers can use to make informed decisions. For example:

✅ Diabetes Management: Continuous glucose monitors (CGMs) track blood sugar levels in real-time, enabling patients and providers to adjust treatment plans promptly.
✅ Hypertension Management: Home blood pressure monitors track daily readings, helping to manage blood pressure effectively.
✅ Heart Disease: Wearable heart rate monitors and electrocardiogram (ECG) devices provide data that can detect arrhythmias or other cardiac issues early.
✅ COPD: Pulse oximeters measure blood oxygen levels, alerting providers to potential respiratory issues.

📌 CPT Codes for RPM
Proper coding and documentation are crucial for the reimbursement of RPM services. The American Medical Association (AMA) has established specific Current Procedural Terminology (CPT) codes for RPM, which include:
📌 99453: Initial setup and patient education on the use of monitoring equipment.
📌 99454: Supply of devices with daily recordings or programmed alerts transmission for 30 days.
📌 99457: Remote monitoring of physiologic parameters (e.g., weight, blood pressure, pulse oximetry, respiratory flow rate) with a 20-minute monthly interactive communication.
📌 99458: Additional 20 minutes of remote monitoring and management services.

✅ Remote Patient Monitoring (RPM) has emerged as a transformative approach in healthcare, particularly in chronic disease management. It is significant in enabling continuous patient monitoring outside traditional clinical settings, using advanced technology to facilitate real-time data collection, analysis, and intervention. This article delves into the practical application of RPM, its CPT codes, and its surge in popularity, particularly during the COVID-19 pandemic.

✅ RPM involves using digital devices to collect health data from patients in one location and electronically transmit it to healthcare providers in different locations for assessment and recommendations. Standard components of RPM include:
📌 Wearable Devices include heart rate monitors, glucose meters, and blood pressure cuffs.
📌 Mobile Apps that sync with wearable devices to track and share health data.
📌 Telehealth Platforms that facilitate communication between patients and providers.

🕡 Pre-PHE vs. Post-PHE Landscape:

⌛ Pre-PHE: During the PHE, the Department of Health and Human Services (HHS) implemented enforcement discretion for telehealth-related HIPAA regulations. Healthcare providers were not penalized for using non-public-facing communication technologies (like FaceTime or Skype) for telehealth services as long as they were used in good faith.

⏰ Post-PHE: On May 11, 2023, the PHE ended, with it, the enforcement discretion for telehealth HIPAA compliance. Healthcare providers must now use HIPAA-compliant platforms to deliver telehealth services. As of August 9, 2023, the transition period ended.

⛔ U.S. Attorney Announces Settlement Of Civil Fraud Lawsuit Against VNS Health And Related Entities For Billing For Services They Failed To Provide Or Document!

📌 Defendants Will Pay Nearly $1 million and Admit That They Sought and Received Payments for Assertive Community Treatment Services They Failed to Provide or Document. The settlement resolves claims that VNS violated the False Claims Act by fraudulently billing Medicaid for services that it either failed to provide or failed to document to persons with serious mental illness at the ACT Program. Specifically, the settlement resolves claims that from January 1, 2014, through December 31, 2018, VNS submitted or caused to be submitted false claims to Medicaid for monthly payments for 103 patients.

⚠ Complete and accurate documentation ensures patients receive proper reimbursement for covered services.

⚠ Detailed records not only support billing but also provide a clear picture of the patient’s condition and treatment plan. This is crucial for ensuring quality care and continuity across healthcare providers.

⚠ When billing aligns with documentation, it reduces the risk of potential accusations of overbilling or improper coding, which can harm patient trust.

📌 Remember, if it is not documented, it was not done! You can’t bill for something that was not documented; that is Fraud! I always stress this during presentations and teaching. Actually, we talked about this last night in my class. Take note, read the article, and ensure your organization is compliantly billing services and procedures that are documented and also medically necessary.
