Most Canadians think the Disability Tax Credit (DTC) is just a minor tax break on this year’s return. That’s only the beginning.

Here is what you need to know about these 5 hidden DTC rules:

1️⃣ 10-Year Retroactive Refunds: If you qualified in past years but never applied, the CRA allows you to adjust up to a decade of prior tax returns.

2️⃣ Gateway to Other Programs: Approval opens doors to the Registered Disability Savings Plan (RDSP), provincial supports, and the Canada Disability Benefit.

3️⃣ Employment Status Doesn’t Block You: Approval is based on daily functional impact, not whether you hold down a job.

4️⃣ Credit Transfers: If you don’t owe income tax, unused credits can often be transferred to a supporting spouse, parent, or family member.

5️⃣ Denials Aren’t the End: Many CRA rejections happen simply because Form T2201 wasn’t documented correctly—not because the medical condition didn’t qualify.

Only 40% of eligible Canadians are actually claiming the DTC. Don’t wait months to years between appeals by doing it alone.

The biggest myth about Canada’s Disability Tax Credit (DTC)? That you need a wheelchair or a visible impairment to qualify.

The DTC isn’t based on a diagnosis alone. CRA looks at how a prolonged impairment affects your ability to perform certain everyday activities compared with someone without the impairment — and whether the restriction meets the DTC’s eligibility criteria.

That means conditions such as severe ADHD, anxiety, chronic joint pain, IBS, and Type 1 diabetes may be relevant, depending on how they affect your day-to-day functioning and the specific DTC criteria.

If approved, the DTC can also lead to reassessments for previous tax years, potentially going back up to 10 years when the requirements are met.

CRA makes the final decision on DTC eligibility.

Many Canadians miss out on the Disability Tax Credit (DTC) because they assume it’s only for people who can’t work or who receive disability income support.

That’s not how the DTC works.

Under the Income Tax Act, your employment status or whether you receive provincial support like ODSP does not, by itself, determine eligibility.

Instead, the CRA looks at how a prolonged limitation affects your ability to perform everyday activities. This can include walking, dressing, feeding yourself, or certain mental functions.

For some people, everyday tasks may take significantly longer than they do for someone without the same limitations, or require substantially more effort and assistance. The CRA considers these functional impacts when reviewing an application.

Examples can include challenges related to chronic pain, diabetes management, ADHD, autism, anxiety, depression, and other prolonged limitations. However, having a particular condition does not automatically mean someone qualifies.

The CRA may also review previous tax years, potentially going back up to 10 years. Depending on your individual tax history and the years approved, this could result in retroactive tax relief.

Our team offers a free initial assessment to help you understand whether your situation may fit the DTC framework. The CRA makes the final decision on every application.

Most Canadians living with a daily health condition have no idea they could qualify for the Disability Tax Credit (DTC)—and up to 10 years of retroactive tax adjustments.

You don’t need to be receiving provincial disability or out of work to qualify. Under CRA guidelines, if a physical or mental health condition restricts your daily routine 90% of the time, your family could be eligible for significant back-pay.

Unused credits can even be transferred to a supporting family member if you don’t owe income tax yourself.

❓ Does the Disability Tax Credit Expire?

Here is how the CRA handles approval periods:

Temporary Approval: The DTC usually expires in 4–6 years if there is a chance of medical improvement. The CRA approves the credit for that specific timeframe, after which re-application may be required.

Indefinite Approval: If the condition is permanent and unlikely to change, it may be granted indefinitely. 🗓️

Navigating expiry dates and re-applications can be stressful, but our team makes maintaining your benefits effortless.
