Clean water is essential to life...but according to a recent federal appeals court ruling, it is not a fundamental right guaranteed by the U.S. Constitution.
On September 4, 2026, the Fifth Circuit ruled 10–5 in Sterling v. City of Jackson, a case involving residents who alleged exposure to contaminated municipal water.
This does not mean drinking-water laws have disappeared. Federal and state protections including the Safe Drinking Water Act still apply. The ruling means the Constitution alone does not provide the specific legal right the residents asked the court to recognize.
The decision is a sobering reminder: we cannot afford to be passive about the quality of the water entering our homes and bodies.
Water education matters. Awareness matters. Knowing what you’re drinking matters. 💧
