Legal Update: The PUMP Act - What employers need to know: The Providing Urgent Maternal Protections (PUMP) for Nursing Mothers Act is a new law effective
on December 29, 2022 that expands the Break Time for Nursing Mothers law, adding breastfeeding protections to an additional 9 million working women of childbearing age in the U.S.

Break times:
• Employees must be able to take a pumping break any time they need to during the
course of their workday. The number of breaks may not be limited by the employer.
• Employees must be allowed to use any existing paid or unpaid breaks, but cannot
be required to use those existing breaks. Furthermore, employers cannot define
the length of a pumping break, and must include time for the employee to get to
the space, set-up, and clean up.
• If employees conduct any work at all during a pumping break, that time must be
paid and counts toward overtime calculations. Employers cannot force employees
to work during their break. If the employee is relieved of all duties, then the break
can be unpaid.

Lactation spaces:
• A private, functional space must be provided for the purpose of expressing breast
milk. This space must be available to lactating employees any time they need it.
• The space must be shielded from view – including cameras or other surveillance –
and free from intrusion by coworkers or the public.
• The space MUST NOT be a bathroom.

New FAQs on ACA’s Cost-sharing Limit and No Surprises Act

On July 7, 2023, the Departments of Labor, Health and Human Services, and the Treasury (Departments) issued frequently asked questions (FAQs) on the implementation of the Affordable Care Act’s (ACA) overall cost-sharing limit and the No Surprises Act’s (NSA) protections against surprise medical billing.

NSA Protections and Cost-sharing Limit

Effective for plan years beginning on or after Jan. 1, 2022, the NSA provides federal protections against balance billing and limits out-of-network cost sharing for emergency services, nonemergency services furnished by nonparticipating providers concerning a visit to a participating health care facility, and air ambulance services furnished by nonparticipating providers of air ambulance services.

Several key deadlines for employer-sponsored health plans were extended during an “outbreak period” associated with the COVID-19 national emergency. Now that the COVID-19 national emergency has ended, these deadline extensions are also ending.

According to FAQs issued by the Departments of Labor, Health and Human Services, and the Treasury (Departments), the outbreak period and all extensions ended on July 10, 2023.

During the outbreak period, certain health plan deadlines were extended to give individuals more time to make decisions about their health coverage. The extensions applied to deadlines for:
Requesting special enrollment under HIPAA;

Electing COBRA continuation coverage and paying COBRA premiums; and

Submitting claims for health plan benefits and appealing denied claims.

Action Steps:
With the end of the deadline extensions health plans can return to their normal pre-pandemic deadlines. In addition, employers should ensure that any plan communications regarding deadlines are updated.
