Let me ask you something…
If the Fourth Amendment protects us against unreasonable searches and seizures, how can federal agents search your cellphone without a warrant or even reasonable suspicion?
Well, on September seventeenth, twenty twenty-six, the U.S. Court of Appeals for the Second Circuit ruled in United States v. Alisigwe that border agents can manually search a traveler’s cellphone at the international border without either.
That ruling governs federal courts in New York, Connecticut, and Vermont.
But here’s what you need to understand. ⚖️
The court addressed manual cellphone searches at the border. It did not decide whether more invasive forensic searches require reasonable suspicion.
Think about what’s inside your phone.
Your banking information. Your private conversations. Your family photos. Your business records. Your entire digital life.
At what point does national security outweigh personal privacy?
And here’s the bigger question:
