I was told that appealing the states decision to terminate my dad’s Medicaid HCBS long term care waiver was only buying time…..maybe that’s true but it’s still time that we can use and are going to keep trying.

Background: the social security fairness act pushed my dad over cap against his will. There are no trusts and only 2 options:

1. Pay $32,000 deductible each year to get his services back

2. Go into a nursing home

Let’s stop passing the buck and take some ownership.

Here’s a tiny piece of my correspondence with Senator Collins office which prompted Governor Mills letter today:

“I understand your statement that this is a state issue, however it is most certainly an oversight within the Social Security Fairness Act which is a Federal issue. I am requesting that you please review this again and also share with appropriate members.

If we were a Qualified Income Trust state the overage could be put into a trust and Mainers like my father could continue receiving their medical benefits. But we are not.
I am really surprised and disappointed that for being so instrumental in this Act, that Senator Collins did not take into consideration the consequences for long term care recipients.

The Fairness Act has pushed my Dads income over the cap by $118.00
He did not ask for this increase and he cannot refuse it.
He will be losing his HCBS waiver services as of 10/14.
The only 2 options the state of Maine has:
1. He needs to pay $16k in medical bills every 6 months (medically needy spend down)
He makes $24k per year and needs to pay $32k to receive services…..does that add up??
2. Go into a nursing home. I cannot tell you how deeply this hurts. It basically undermines years of successful home and community based living, his wishes and his families wishes.

U.S. Senator Susan Collins please fix the fairness act to include protections for Maine seniors like my Dad! 🙏
